Terms of Service

These Terms of Service (“Terms”) govern your use of FenceCalc, a fence estimating and business management platform operated by FenceCalc (“we,” “us,” or “our”). By creating an account or using our services, you agree to these Terms.

1. Accounts

To use FenceCalc, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 18 years old to create an account.

You may invite team members to your account. As the account owner, you are responsible for their activity within FenceCalc.

2. Subscriptions & Billing

FenceCalc offers a subscription plan at $79/month or $59/month billed annually. All new accounts begin with a free 14-day trial. After the trial period, you must subscribe to continue using FenceCalc.

  • Subscriptions renew automatically unless canceled before the renewal date
  • You may cancel anytime from your account settings — no cancellation fees
  • Refunds are not provided for partial billing periods
  • We reserve the right to change pricing with 30 days' notice

3. Acceptable Use

You agree to use FenceCalc only for lawful business purposes related to fence estimating, project management, and customer communications. You agree not to:

  • Use FenceCalc for any illegal or unauthorized purpose
  • Attempt to reverse engineer, decompile, or disassemble the software
  • Upload malicious code, viruses, or harmful content
  • Share your account credentials with unauthorized users
  • Use the platform to send spam or unsolicited communications
  • Interfere with or disrupt the service or its infrastructure

4. Data Ownership

You own your data. All fence estimates, material calculations, PDF proposals, customer information, crew schedules, invoices, and other business data you create in FenceCalc belongs to you.

  • You grant us a limited license to store, process, and display your data solely to provide the FenceCalc service
  • You can export your data at any time in CSV format
  • Upon account cancellation, your data remains available for export for 30 days
  • We will not sell, share, or use your business data for purposes unrelated to providing the service

5. PDF Proposals & Customer-Facing Content

FenceCalc generates PDF proposals and customer portal pages using your company branding, pricing, and estimate data. You are solely responsible for the accuracy of pricing, material specifications, scope of work, and any representations made in proposals sent through FenceCalc.

6. Material Pricing & Calculations

FenceCalc provides material calculations and default pricing as estimates only. Actual material costs, quantities, and availability may vary based on your supplier, region, and market conditions. You are responsible for verifying material quantities and pricing before purchasing or committing to a job.

7. Warranties & Disclaimers

FenceCalc is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that:

  • The service will be uninterrupted, error-free, or secure
  • Material calculations or pricing estimates will be accurate for your specific use case
  • The service will meet all of your business requirements

We make reasonable efforts to ensure accuracy and uptime, but fence estimating involves variables beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, FenceCalc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the service.

Our total liability for any claims related to the service shall not exceed the amount you paid to FenceCalc in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold FenceCalc harmless from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that harms FenceCalc or its users. You may terminate your account at any time by canceling your subscription and contacting support.

11. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes arising from these Terms or your use of FenceCalc shall be resolved exclusively in the state or federal courts located in Harris County, Texas.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the FenceCalc platform. Your continued use of FenceCalc after changes constitutes acceptance of the updated Terms.
